Ticketing Terms and Conditions
The purchase of a ticket from or through Chief’s on Broadway for a given event constitutes
acceptance by the purchaser and holder (hereinafter referred to as “You” or “Your”) of the
following terms and conditions. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY
PRIOR TO MAKING ANY TICKET PURCHASE — IF YOU HAVE ANY QUESTIONS, PLEASE CONTACT

TICKETS
Your ticket is a revocable license to attend a specific event at Chief’s on Broadway. You must
produce a valid ticket to gain access to an event and You must retain possession of Your ticket at
all times during the event. Entry into the event is limited to persons that meet the minimum
age requirements on or before the day of the event as evidenced by an approved form of
identification to enter the event that demonstrate proof of age. Chief’s on Broadway reserves
the right to revoke and/or invalidate Your ticket upon discovery of any violation of these terms
and conditions, and may refuse admission to or eject anyone, without refund, who is deemed to
be disorderly or who fails to comply with the terms of this license, and/or for any attempted or
actual violation of any of the rules set forth herein, policy or regulations and for any other
action taken by You in violation of any applicable law, or that may endanger other ticket holders.
Chief’s on Broadway reserves the right to refuse You entry to and/or eject You from the event
(and may take appropriate action to enforce this right) in reasonable circumstances including,
without limitation: (i) for health and safety reasons, (ii) if You behave in a manner likely to
adversely impact the enjoyment of other persons at the event, (iii) if You use or display
threatening, abusive or insulting words or gestures, (iv) if, in the reasonable opinion of Chief’s
on Broadway, You appear to be acting under the undue influence of alcohol or drugs, (v) if You
fail, when required, to produce proof of identity or age, (vi) if You refuse to comply with
reasonable security searches while at Chief’s on Broadway, or (vii) if You breach these terms and
conditions. No refunds will be given if You are refused entry or ejected due to Your behavior in
violation of these terms and conditions.
EXCEPT AS EXPLICITLY PROVIDED HEREIN, ALL TICKET SALES ARE FINAL AND THERE WILL BE NO
REFUNDS AND/OR EXCHANGES. Chief’s on Broadway is not responsible for any lost, stolen, or
destroyed ticket, nor any loss or inconvenience caused by any unauthorized duplication of Your
ticket. Lost, stolen, counterfeit or otherwise unlawfully duplicated tickets, or those offered for
resale at an unlawful premium, or on an unauthorized secondary marketplace, may not be
honored. Tickets obtained from an unauthorized source may be invalid, lost, stolen, or
counterfeit and if so, may be deemed void by Chief’s on Broadway.
Unlawful sale or attempted sale is prohibited and grounds for seizure or cancellation without
refund or other compensation. You may not resell or transfer a ticket if prohibited by law. In
addition, resales or transfers of tickets may be prohibited by Chief’s on Broadway and/or the specific terms and conditions of a given event, including (without limitation) events where age
restrictions apply and/or charity events. Unlawful resale (or attempted resale) of tickets is
grounds for seizure and cancellation without compensation. Certain maximum resale premiums
and restrictions may appl, and You are responsible for complying with all applicable ticket resale
laws, rules and regulations when listing your tickets on any resale platform. NOTE: This ticket is
not transferable, and a government-issued ID of the ticket purchaser must be presented with
the ticket for entry. **Verbiage above in yellow will be for shows in which we do not allow
resale. Ex: Eric Church’s residency]
EVENT CHANGES AND/OR CANCELATIONS
THE EVENT MAY BE SUBJECT TO CANCELLATION AND THE DATE, TIME, LOCATION, TICKET
PRICES, AVAILABILITY, AND/OR AMENITIES, ADMISSION REQUIREMENTS, PERSONAL CONDUCT
AND/OR SECURITY REQUIREMENTS, OR FEATURED PERFORMERS FOR A GIVEN EVENT ARE
SUBJECT TO CHANGE. It is Your responsibility to ascertain whether an event has been cancelled
or rescheduled and the date and time of any rescheduled event. Where an event is cancelled or
rescheduled, Chief’s on Broadway will use reasonable efforts to notify ticketholders via the email
address provided at the time of purchase. Chief’s on Broadway does not and cannot
guarantee that You will be informed of such cancellation before the date of the event. If an
event is rescheduled, this ticket may only be exchanged pursuant to procedures established by
Chief’s on Broadway and communicated to You in writing.
If an event is cancelled (and not rescheduled), in whole, or in part, due to a Force Majeure Event
(as defined below), You will not be entitled to a refund. Notwithstanding the foregoing, Chief’s
on Broadway may issue, at its sole and absolute discretion, a partial or full refund of Your ticket
in such amount determined, among other considerations, by extent and nature of the
cancellation. A “Force Majeure Event” shall mean, as determined by Chief’s on Broadway in its
sole discretion, an act of God, enemy or hostile government action, terrorist attacks, civil
commotion, insurrection, sabotage, strikes or lockouts or other similar cause, earthquake,
wildfire, flood, tsunami, an applicable order or injunction of any court or administrative body or
any other act of public authority, severe weather threatening the safety of event attendees or
similar contingency or unexpected event, in each instance beyond the reasonable control of
Chief’s on Broadway. You acknowledge and agree that in all instances, the maximum remedy
you may receive for any cancellation of any part of the event, if any, will be the face value of
Your Ticket, excluding all fees, taxes and/or service charges paid by You in connection with the
purchase of Your ticket. For the avoidance of doubt, service fees charged by TixR and credit
card processing fees charged by TixR and/or credit card processing entities are non-refundable.
Chief’s on Broadway will work diligently to ensure issuance of any approved refunds as soon as
practicable. Chief’s on Broadway cannot issue refunds for any ticket obtained from an
unauthorized third-party reseller; only tickets purchased from a third-party ticketing company
authorized to sell tickets on behalf of Chief’s on Broadway may be eligible to receive a refund
from such authorized ticketing company.
Tickets may not be used for advertising, promotion, or other trade purposes, or in association
with any sweepstakes, contest or similar activity, without the prior written consent of Chief’s on
Broadway. Any such unauthorized use will result in such ticket(s) automatically becoming void
at the sole discretion of Chief’s on Broadway with no refund provided.
RECORDINGS
By attending an event, You acknowledge and agree that You may be photographed and filmed
while in attendance, and You hereby grants permission to Chief’s on Broadway (and its
designees, licensees and agents) to utilize, use, reproduce, modify, display, and publish Your
image, likeness, actions and statements in any live or recorded audio, video, or photographic
display or other transmission, exhibition, publication or reproduction made of, or at, the event
in any context or media now or hereafter existing for any purpose, including commercial or
promotional purposes, without further authorization or compensation.
The use of personal devices and/or equipment for recording or transmitting (by digital or other
means) any audio, visual or audio-visual material within Chief’s on Broadway may be strictly
forbidden in connection with certain events as determined by Chief’s on Broadway and/or
required by a given performer. In such instance, any recording or transmitting equipment
(including professional cameras), unauthorized recordings, tapes, films or similar items may be
confiscated and/or destroyed by Chief’s on Broadway, and any unauthorized recording made of
an event or part thereof in breach of these terms and conditions shall belong to Chief’s on
Broadway and You agree to assign any and all rights in any such recordings to Chief’s on
Broadway upon written request therefor.
This performance will be phone-free. You will be asked to lock your cell phone in a Yondr pouch
before entry. Your phone will remain with you during the performance in the locked pouch.
Following the performance, our team will be ready to assist with unlocking your pouch. Rest
assured that you and all other guests will maintain possession of your devices at all times and
can access them throughout the event in designated Phone Use Areas within the venue. If you
need to leave at any time during the performance to use your phone, there will be a station on
the 2nd floor where your phone can be unlocked. To ensure you don’t miss a minute of the
show, it is highly recommended that you make all of your last-minute phone calls and texts prior
to your arrival at building entry.
ASSUMPTION OF RISK
By purchasing a ticket, You assume all risks, hazards, and dangers of personal injury (including
sickness and death, exposure to Covid-19, a bacteria, virus, or other pathogen capable of
causing a communicable disease or illness), property damage, and all other hazards arising
from, or in any way related to the event, whether occurring before, during, or after an event,
however so caused.
INDEMNIFICATION
You hereby indemnify and hold harmless Chief’s on Broadway, 200 Broadway Owner LLC, 200
Broadway Lessee LLC, their affiliates, and each of their respective representatives, officers,
directors, owners, members, trustees, investors, agents, attorneys, employees, successors and
assigns, TixR, and any other authorized ticketing agent of Chief’s on Broadway, event sponsors/
promoters, and the performing artists, including, but not limited to, their respective
management, their agents, their staff and their designees (collectively, the “Indemnified
Parties”) harmless from any loss, liability, damage or cost in any way arising out of, or related to,
Your actions and omissions at, around, or while traveling to and from, the ticketed event.
You hereby waive, discharge, hold harmless and covenant not to sue the Indemnified Parties
from any and all liability arising out of, or in connection with, the event, for any claims, causes of
action, obligations, lawsuits, charges, complaints, controversies, damages, costs or experiences
of whatsoever kind, nature, or description, whether direct or indirect, in law or in equity, in
contract or in tort, or otherwise, whether known or unknown, arising out of, or related to, the
event, Your attendance at the event, or Your travel to and from the event, except to the extent
caused by the gross negligence or willful misconduct of the Indemnified Parties.
IN NO EVENT WILL THE INDEMNIFIED PARTIES BE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, DIRECT, INDIRECT, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OR LOST PROFITS, REVENUES OR BUSINESS OPPORTUNITIES, OR OTHER DAMAGES OF ANY TYPE, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, ARISING OUT OF, OR IN CONNECTION WITH, THE EVENT OR ANY PRODUCT OR SERVICE PURCHASED AT THE EVENT, EVEN IF THE INDEMNIFIED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER THE CLAIM IS BASED UPON ANY CONTRACT, TORT, OR OTHER LEGAL OR EQUITABLE THEORY. WITHOUT LIMITING THE FOREGOING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE INDEMNIFIED PARTIES WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR (1) ANY FAILURE OF ANOTHER ATTENDEE OF THE EVENT TO CONFORM TO THESE RULES, (2) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, WHETHER ARISING IN CONTRACT OR IN TORT, RESULTING FROM YOUR ATTENDANCE AT THE EVENT, (3) ANY ERRORS, MISTAKES, INACCURACIES OR OMISSIONS IN ANY CONTENT, OR (4) ANY LOST, STOLEN OR DAMAGED TICKETS, OR FAILURE OF EVENT STAFF OR SECURITY TO HONOR YOUR TICKET. YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE EVENT IS TO LEAVE THE EVENT – IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE BY YOU. THESE LIMITATIONS WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS ITS ESSENTIAL PURPOSE. SUBJECT TO APPLICABLE LAW, THE ALLOCATION OF RISK BETWEEN YOU AND THE INDEMNIFIED PARTIES IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN US. THE FOREGOING EXCLUSION OR LIMITATION OF DAMAGES AND LIABILITY ARE SUBJECT IN ALL RESPECTS TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
By purchasing a ticket to this event, You agree to these terms and conditions. Chief’s on
Broadway reserves the right to add, change, discontinue, remove or suspend any of the
foregoing terms and conditions, temporarily or permanently, at any time, without notice and
without liability.
We urge you to confirm the title, time and location of the event before purchasing Your tickets.
It is Your responsibility to check Your tickets again upon receipt and contact
boxoffice@chiefsonbroadway.com promptly upon discovery of any discrepancy or mistake.
